The Act applies to commercial disputes of a specified value, which are defined as disputes arising from ordinary business transactions, such as those involving mercantile documents, partnerships, maritime law, aviation, infrastructure, immovable property, franchising, intellectual property rights, insurance, and other commercial contracts. The Act also addresses commercial arbitration, international commercial arbitration, and commercial disputes involving the government. The commercial courts have jurisdiction over disputes that exceed Rs. 3,00,000/-.

The Commercial Court Act also empowers India's five High Courts—the High Courts of Delhi, Bombay, Madras, Calcutta, and Himachal Pradesh—to exercise original civil jurisdiction. The issues that surpass Rs. 1,00,00,000/- will be heard by the High Court's original civil jurisdiction in the five states listed above. The Act requires the formation of commercial courts at the district level, as well as commercial divisions in High Courts. These specialised courts are designed to handle complex commercial disputes and are staffed by judges who are experts in commercial law. The courts must adopt the code of civil procedure, 1908, and the modified Schedule of the Commercial Court, Act.

One of the key goals of the Act is to speed up the resolution of commercial disputes. To do this, the Act establishes rigorous timetables for each stage of the lawsuit process. The Commercial Courts are supposed to resolve matters within six months of filing, which may be extended for an additional six months in extreme situations. Appellate courts are also supposed to resolve appeals within six months.

It provides pre-litigation mediation between the parties. It requires the parties to examine the possibility of resolving their commercial issues through mediation before going to court or beginning litigation, with the exception of suits that do not require urgent interim relief. If the counter-party fails to present or the mediation procedure fails, the party may file a claim in commercial court. The mediation process must be completed within three months of filing the application. However, an additional two-month period may be allowed if needed.

Appeals from Commercial Court and Commercial Division decrees — Any individual aggrieved by a Commercial Court's judgement or order below the level of a District Judge may file an appeal with the Commercial Appellate Court within sixty days of the judgement or order's date.

Any person aggrieved by the judgement or order of a Commercial Court at the level of District Judge exercising original civil jurisdiction or, as the case may be, Commercial Division of a High Court may appeal to the Commercial Appellate Division of that High Court within sixty days of the date of the judgement or order.Provided that an appeal shall lie from such orders passed by a Commercial Division or a Commercial Court that are specifically enumerated under Order XLIII of the Code of Civil Procedure as amended by this Act and section 37 of the Arbitration and Conciliation Act, 1996.

Notwithstanding anything contained in any other law for the time being in force or Letters Patent of a High Court, no appeal shall lie from any order or decree of a Commercial Division or Commercial Court otherwise than in accordance with the provisions of this Act.

Summary Judgment: The commercial court may grant summary judgement conditionally or unconditionally upon filing an application by any party without recording oral evidence (after summons has been served and issue has not been framed), if the court believes the plaintiff or defendant has no real prospect of succeeding in their claim/case.
